Dune Data Hub Service Addendum

This Addendum applies in addition to the General Terms and Conditions for the use of Dune and applies specifically to the circumstances where Users upload their own datasets, in different formats into Dune for use in connection with the other Dune Services.

The Dune Data Hub Service

The Data Hub Service allows users to upload data into Dune from different sources and formats, including, but not limited to, CSV files, the Users’ own databases, or other privately acquired / held data (the “Uploaded Data”), which may then be subsequently used in the Dune Services by the User or other Users, according to the settings defined by the User when uploading the data.

The Uploaded Data may be a Public Uploaded Data, if uploaded by a User in a Team’s namespace and designated as public data (meaning that any other User in Dune can have access to the data), or a Private Uploaded Data, if uploaded to a namespace of Team and designated as private data (which means that only members of that Team will be able to interact with such Private Uploaded Data).

For Private Uploaded Data that is also personal data, the Data Processing Agreement shall apply. The User uploading personal data agrees to the Data Processing Agreement available on the Dune website.

After the data is uploaded, the User (and other Users, as provided below) will be able to use the Uploaded Data through the Dune Services. When creating a new dashboard with the Uploaded Data, the User shall define whether such dashboard is public or private. Dune recommends discretion when using Private Uploaded Data in public dashboards, including, but not limited to, exposing only anonymized or pseudonymised data in such public dashboards. The User is solely responsible and liable for not exposing personal or confidential information or data in the public dashboards.

License to Uploaded Data

Users should not designate Uploaded Data as public unless they have the necessary rights to make the data publicly available and to grant the license below.

Regarding any Public Uploaded Data, the User hereby grants to Dune and to other Users a non-exclusive, non-transferable, royalty-free, fully paid-up, irrevocable, worldwide right and licence to download, keep, store, make copies, and use such Public Uploaded Data for any purposes.

For avoidance of doubt, Dune may keep copies and allow other Users to use the copies of the Public Uploaded Data. Subject to applicable law and valid rights requests, Dune is not required, under any circumstance, to delete the Public Uploaded Data, including after the deletion of the User Account.

Restrictions

The User shall not, under any circumstance, upload to the Dune Data Hub Services:

  • Any illegal content and data;
  • Any data or content that is misleading, false, or erroneous;
  • Confidential data that belongs to another party, being that a person or a company; or
  • Personal data or personally identifiable information, except where uploaded as Private Uploaded Data in accordance with this Addendum, the DPA, and applicable law.

Exception regarding Private Uploaded Data

Exclusively regarding Private Uploaded Data, a User may upload personal data or confidential information. In the case of Private Uploaded Data that is personal data, the Data Processing Agreement applies.

A User shall consider that the other Users in the team may also download, keep, store, make copies, and use the Uploaded Data in public or private dashboards before uploading any data that may be confidential or sensitive.

Dune is not responsible or liable for (i) the exposure of personal or confidential data in a public dashboard nor (ii) the use of the Private Uploaded Data by other members of the Team.

Private Uploaded Data may not include special categories of personal data, criminal offence data, payment card data, health data, children’s data, government identifiers, or other highly sensitive regulated data unless Dune has expressly agreed in writing.

Reporting of Data that Violates these Terms

Any User that becomes aware of data uploaded to Dune that violates these Terms can report the violation to Dune at [email protected].

Dune shall review the report and conclude, at its sole discretion, if the data violates the Terms of Service and its Addenda. In such cases, Dune may request additional information from the User that uploaded the data.

Deletion of Data by Dune

Dune may remove or restrict any data that Dune believes, at its sole discretion, violates the Terms of Service. Prior to such action, or simultaneously at the latest, Dune will notify the User in question of the violation and the action that will be carried out. The notice will also include information about Dune’s grounds for action and options for redress.
